The buyer's interaction with the SVITPARTS online store assumes that the visitor to the svitparts.com.ua site has familiarized himself with the rules of use of the site, the public offer, the rights of the parties, the privacy policy and all the conditions listed below.

Public offer of SVITPARTS online store

The contract of official public offer is considered open, that is, referring to provision 633 of the Civil Code of Ukraine, its elements are absolutely similar for every buyer, regardless of his status (whether a natural person or a legal entity). In case of exact agreement with this Agreement, the buyer undertakes all its provisions and all actions on the svitparts.com.ua website, including placing an order, paying the price of the product, as well as its delivery.

This article is a grant of an agreement between the SVITPARTS online store and any legal or physical person who interacts with the svitparts.com.ua website, and will be referred to in the following text as the "Buyer", and will also have the opportunity to independently choose the conditions for purchasing goods through the existing site svitparts.com.ua

This agreement has the form of a public offer, and is also considered a synonym for "oral agreement", which according to the current laws of Ukraine has legal force.

Definition

The offer contract, which was discussed above, is presented as an example on the svitparts.com.ua website. Compliance with its text is mandatory for the Seller and the Buyer. Basic terminology in the relationship between the Buyer and the Seller:

A product is a market element offered by the seller's website.
Acceptance - the process of the Buyer's agreement with the purchase of the Product, information (price, text, graphics, media content describing the properties of this product), which is available on the svitparts.com.ua website. It takes place after the selected order registration procedure.
The buyer is an adult and able-bodied person who entered the site in order to purchase the product he needed, having previously accepted all the provisions of the contract in this process.
Order - a completed application from the Buyer, sent to the Seller, for the purchase of a product.

1. General provisions of interaction between the client and the SVITPARTS online store

This document is considered a public offer and an endowment with all the necessary points of sale.
All documents between the Seller and the Buyer have the status of a public offer contract. Selecting the "Buy" button on the page of the svitparts.com.ua website and later - "Place order" means that the Buyer, regardless of his status, undertakes to comply with all provisions of the Agreement.
The proposed Agreement becomes fully effective immediately after the order is confirmed on svitparts.com.ua.

The main and general requirements of the Buyer's interaction with the SVITPARTS online store are to respect the rights of both parties.

2. Basic rights of the seller

2.1. The seller has the following responsibilities:

fully comply with all proposals of this Agreement
to fulfill all the Buyer's orders without any problems, if the payment was made by him
undertake a thorough check of all components of the Product, its integrity and safety, at the time when its packaging is carried out
deliver the goods, designed in accordance with all established regulations, for the Buyer in Kyiv, as well as in the cities of Ukraine: Kharkiv, Odesa, Dnipro, Zaporizhzhia, Lviv, Kryvyi Rih, Mykolaiv, Vinnytsia, Kherson, Chernihiv, Poltava, Cherkasy, Zhytomyr, Sumy, Khmelnytskyi, Chernivtsi, Kropyvnytskyi, Kremenchuk, Ivano-Frankivsk, Ternopil, Lutsk, Uzhhorod, Kamianske, Bila Tserkva, Nikopol, Sloviansk, Pavlograd, Kamianets-Podilskyi, Brovary, Irpin, other settlements.

2.2. The buyer has responsibilities:

without any help, independently undertake the order registration procedure on the Seller's portal
when placing an order, enter only valid personal data in order to receive the selected order
pay for the order without delay and receive it in accordance with the provisions of the Agreement
study the characteristics of the product in detail on the Buyer's website
while going through the procedure of receiving the goods, he will carefully familiarize himself with its condition and the integrity of the contents.

3. Privacy Policy

Fully complying with the Law of Ukraine "On the Protection of Personal Data", the Buyer fully consciously agrees to the processing of his personal data by a third party - the Seller.

The SVITPARTS online store uses cookie technology on its website, and the Buyer's interaction with the online store implies consent to this. Any information received from the user cannot be transferred to third parties. Interaction with the SVITPARTS online store site, the Buyer accepts the following positions:

The purpose of the Buyer's introduction of his personal information - SVITPARTS online store undertakes the processing of personal data in order to communicate with the Buyer. This is done in order to inform the Buyer about the availability of the goods, as well as to confirm his order and the method of delivery. In addition, the online store can inform about seasonal promotions and sales.
Making changes to personal information by the Buyer - the buyer can, if necessary, change or update the personal data provided to him (often in or completely).
Protection of received confidential data - the administration of the SVITPARTS online store will take all precautionary measures to protect the Buyer's personal information and undertakes not to transfer it to third parties.

4. Use of content on the svitparts.com.ua website

All text, graphics and media content on the svitparts.com.ua website is intended for visitors to our online store for perusal and private, non-commercial use. The content taken from the official websites of the manufacturers of the products presented in the SVITPARTS online store catalog for the purpose of presenting the products of these manufacturers.

The content created by the SVITPARTS online store team may be used under the following conditions:

Use the content of the svitparts.com.ua site only for personal purposes that do not contradict the legislation of Ukraine.
They will not distort text, graphics, media information from the svitparts.com.ua website when using it.
Keep an active link to svitparts.com.ua when using the site's content.
In case of non-compliance with the conditions set forth in clause 4, the SVITPARTS online store reserves the right to use the copyright protection mechanism by all legal means.

6. Return of the Goods

The Buyer has the right to return to the Seller a non-food product of appropriate quality, if the product does not satisfy him in terms of shape, dimensions, style, color, size or for other reasons cannot be used for its intended purpose. The buyer has the right to return the goods of proper quality within 14 (fourteen) days, excluding the day of purchase. The return of goods of appropriate quality is carried out if it has not been used and if its appearance, consumer properties, packaging, seals, labels, as well as the settlement document issued to the Buyer for payment of the Goods have been preserved. The list of goods that are not subject to return on the grounds provided for in this paragraph is approved by the Cabinet of Ministers of Ukraine.
The return to the Buyer of the cost of goods of appropriate quality is carried out within 30 (thirty) calendar days from the moment of receipt of such Goods by the Seller, subject to compliance with the requirements stipulated in clause 6.1. Agreement, current legislation of Ukraine.
The cost of the product is subject to refund by bank transfer to the Buyer's account.
The return of the Goods of proper quality to the Seller's address is carried out at the expense of the Buyer and the Seller does not reimburse the Buyer.
In the event that defects in the Product are detected during the established warranty period, the Buyer personally, in the manner and within the time limits established by the legislation of Ukraine, has the right to submit claims to the Seller provided for by the Law of Ukraine "On the Protection of Consumer Rights". In the case of requests for free elimination of defects, the deadline for their elimination is calculated from the date of receipt of the Goods by the Seller at his disposal and physical access to such Goods.
Consideration of the requirements stipulated by the Law of Ukraine "On the Protection of Consumer Rights" is carried out by the Seller on the condition that the Buyer provides the documents stipulated by the current legislation of Ukraine. The Seller is not responsible for the defects of the Goods that arose after their transfer to the Buyer as a result of the Buyer's violation of the rules of use or storage of the Goods, actions of third parties or force majeure.
The buyer does not have the right to refuse a good quality product that has individually defined properties, if the specified product can be used exclusively by the buyer who purchased it (including, at the buyer's request, non-standard sizes, characteristics, appearance, equipment and other). The confirmation that the product has individually defined properties is the difference in product sizes and other characteristics specified in the online store.
